As a commercial product that this is, it would be impossible to include copyrighted content without a documented authorization to do so. Otherwise, it exposes the business to possible lawsuits. Remember, lawyers will be looking for the money. If this product is successful as a business, that money coming will make the business have the smell of money. This is what usually be the trigger for lawsuits if titles are included without authorization by the copyright holder. Some of the copyright holders businesses back in the 80s went bankrupt and there has been no means of readily contacting them. Some of them passed on and no one knows the affairs of the copyrights. It's complicated. As a business rule, you only include directly what you either own the rights to or has authorization to include by the copyright holders. There is opportunity for them to provide means of adding games and other software to by the user. Lets put it like this, it's the live of the author plus several decades after the person is dead and those rights would transfer to their next of kin or it would be held up in a legal limbo. Copyrights in the U.S. can last over a century. Works for hire is 95 years (up to 120 years depending on certain conditions). Some works that are directly held and owned by the author(s) is the life of the author(s) plus 70 years after the death of the last surviving author. Spork64 is copyright by a group of us and that lasts for our life time + 70 years after the death of the last one of us for our respective work. The very short time frame of the home computer industry and its fast pace may seem like forever but from a copyright law point of view, it is a short time. If anyone of the copyright holders lawyers get bent out of shape that their client/employer isn't getting their share of the money from sales of a product containing their the copyrighted works. There are also individual copyright holders that may get bent out of shape seeing their work being 'profited off of' by a commercial entity without getting their royalties.
